PRACTICE FOCUS

Parks T. Chastain, a member of the firm, focuses on the representation of insurers on a state and national basis. Mr. Chastain represents insurers in the investigation of first party claims, and in litigation arising from first party coverage disputes. He has been involved in litigation dealing with first party policy interpretation, claims handling practice and procedures, bad faith and extra-contractual exposure, arson, misrepresentation and fraud. He has also consulted with insurance carriers regarding the development and drafting of insurance policy provisions and endorsements. At a national level, Mr. Chastain has been retained by various carriers to represent them in the cases involving public adjusters and the appraisal process, as well as the investigation of insurance fraud.

Mr. Chastain is also active in third party liability coverage litigation. He has handled hundreds of cases in which an insurance company’s duty to defend and/or indemnify has been at issue. Mr. Chastain has litigated third party coverage disputes involving construction defect claims, mold claims, as well as litigation arising from policy cancellation and policyholders’ breach of policy terms and conditions.

Mr. Chastain also practices in general civil litigation with an emphasis on claims arising from medical, legal and accountant malpractice, as well as insurance agents’ errors and omissions. He also represents employers in proceedings before the Equal Employment Opportunity Commission, and in litigation arising from alleged discriminatory employment practices.

Born Murfreesboro, Tennessee, June 22, 1965; admitted to bar, 1989, Tennessee, 1991, U.S. Court of Appeals, 6th Circuit, U.S. District Court, Middle District of Tennessee, U.S. District Court, Eastern District of Tennessee, U.S. District Court, Western District of Tennessee.

University of Louisville (B.S., 1986, with highest honors; J.D., 1989, cum laude).
